By using Cable Bahamas’ Internet services, also known as REVON and such services (collectively, the “Services”) provided by Cable Bahamas Ltd., its partners and associates (collectively, “Cable Bahamas”), you agree to the following terms of this Acceptable Use Policy, including the general terms contained below: This Acceptable Use Policy constitutes the agreement between Cable Bahamas (“Cable Bahamas” or “our”) and the customer (“you” or” your”) subscribing to the Services. Cable Bahamas provides a variety of Internet services to residences and businesses: REVON Charge, REVON Boost, REVON Velocity and REVON Extreme. Broadband Internet services allow residential customers to connect to the Cable Bahamas high-speed backbone network, and the Internet. REVON Pro Broadband allows businesses to connect to the Cable Bahamas Broadband backbone network, and the Internet for the purposes of transacting business. The Services use resources that are shared with many customers. Moreover, the Services provide access to the Internet, which is used by millions of others. Each user benefits by being able to share resources and communicate almost effortlessly with other members of the user community. However, as with any community, the benefits and privileges available from the Services, and the Internet in general, must be balanced with duties and responsibilities designed to guarantee uniform access to all customers of the Services. Use of the Services is subject to the following rules and guidelines. You are responsible for ensuring that the use of all Services provided to you complies with this Agreement.

Illegal Activity

Use of the Services for any activity that violates local or international law, order or regulation, is a violation of this Agreement. Prohibited activities include, but are not limited to:

  1. Posting, storing, transmitting or disseminating unlawful material, including without limitation, child or other pornography, any content, data or other material which is libelous, obscene, hateful, unlawful, threatening, reaction or ethnically offensive, defamatory or which in any way constitutes or encourages conduct that would constitute a criminal offense.
  2. Disseminating material which violates copyright or intellectual property rights. The customer assumes all risk regarding whether material is in the public domain;
  3. Pyramid or other illegal soliciting schemes; or
  4. Fraudulent activities; including but not limited to: impersonating any person or entity, or forging anyone’s digital or manual signature.
Security

You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services. The Services may not be used to breach the security of another user, or to attempt access to anyone’s computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools is strictly prohibited. YOU MAY NOT DISRUPT THE SERVICES. The Services also may not be used to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to crash a host. The transmission or dissemination of any information or software that contains a virus or other harmful feature is also strictly prohibited. YOU ARE RESPONSIBLE FOR THE SECURITY OF ANY DEVICE YOU CONNECT TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, DATA STORED ON THAT DEVICE. In particular, Cable Bahamas recommends against enabling file or printer sharing of any kind. Cable Bahamas recommends that any files or services you make available for remote access be password protected.

Inappropriate Content

Cable Bahamas is not responsible for any content you post, store, transmit, disseminate or access through use of the Services. Any content questions or complaints you may have regarding content you access should be addressed to the content provider. 

You are responsible for information published to the Web or other Internet services, through your account. Cable Bahamas reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it, at its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful. 

Cable Bahamas has no obligation to monitor transmissions made on the Services. However, Cable Bahamas has the right to monitor such transmissions and to disclose the same in accordance with Cable Bahamas’ Privacy Policy. By using the Services to publish, transmit or distribute content, a user is warranting that the content complies with this Agreement and licenses and authorizes Cable Bahamas to reproduce, publish, distribute and display such content worldwide.

Electronic Mail

Cable Bahamas limits the number of e-mail messages that you can send through the Services using Cable Bahamas’ e-mail servers in a 24-hour day. Cable Bahamas defines an e-mail message as one message sent to one recipient. For example: a single message addressed to three recipient e-mail addresses would count as three e-mail messages. Cable Bahamas REVON Broadband Internet subscribers are limited to 1000 e-mail messages per 24-hour day and no single e-mail message can be addressed to more than 99 recipient e-mail addresses. Cable Bahamas REVON Pro subscribers are limited to 1000 e-mail messages per 24-hour day and no single e-mail message can be addressed to more than 400 recipient e-mail addresses. The Services may not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages may be sent only to those who have explicitly requested them. 

The Services may not be used to collect responses from unsolicited e-mail sent from accounts on other Internet hosts or e-mail services which violates this Agreement or the acceptable use policy of any other Internet service provider. Moreover, unsolicited e-mail may not direct the recipient to any Web site or other resource, which uses the Services. Forging, altering or removing electronic mail headers is prohibited. However, you may insert additional characters into your from: and reply-to: addresses in order to prevent your true address from being automatically added to the mailing lists used by bulk e-mailers. In this case, your true address must remain obvious to any human viewer. For example, you may substitute nospam.mark.smith for mark.smith.
You may not reference REVON, REVON Broadband or REVON Pro (e.g. including Organization: REVON High-Speed Internet in the header, or by listing an IP address that belongs to Cable Bahamas ) in any unsolicited e-mail, even if that e-mail is not sent through Cable Bahamas. Cable Bahamas owns all IP addresses and e-mail usernames for all Services. Mail Bombing is prohibited. You may not send numerous copies of the same or substantially similar messages, nor may you send very large messages or files to a recipient with the intent to disrupt a server or account. The propagation of chain letters is prohibited, whether or not the recipient wishes to receive such mailings. Cable Bahamas is not responsible for the forwarding of e-mails sent to any account that has been suspended or terminated. Such e-mails will be returned to sender, ignored, deleted, or stored temporarily, at Cable Bahamas’ sole discretion.

Bandwidth, Data Storage and Other Limitation

You must comply with the current bandwidth, data storage and other limitations on the Services. You must ensure that your activity while using the Services does not improperly restrict, inhibit or degrade any other customer’s use of the Services, nor represent (in the sole judgment of Cable Bahamas.) an unusually large burden on the network itself, such as, but not limited to, peer-to-peer (P2P) file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. The guidelines for Bandwidth Usage/month for each service package are the following: REVON Charge, 100 gigabytes; REVON Boost, 175 gigabytes; REVON Velocity, 250 gigabytes; REVON Extreme, 300 gigabytes; REVON Pro 10, Unlimited; REVON Pro 14, Unlimited; REVON Pro 18, Unlimited; (all bandwidth is based on combined download and upload). Cable Bahamas reserves the right to set specific limits for Bandwidth Usage and charge for excessive Bandwidth Usage for residential services at any time. In addition, you must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede Cable Bahamas’ ability to deliver the Services and monitor the Services, backbone, network nodes and/or other network services.

UNDER NO CIRCUMSTANCES, WHATSOEVER, ARE YOU PERMITTED TO RESELL, SHARE, OR OTHERWISE DISTRIBUTE THE SERVICES OR ANY PORTION THEREOF TO ANY THIRD PARTY WITHOUT THE WRITTEN CONSENT OF CABLE BAHAMAS AND PAYMENT OF APPLICABLE FEES. For example, you cannot provide Internet access to others through a dialup connection, host shell accounts over the Internet, provide e-mail or news service, or send a news feed unless express permission is granted by the customer agreement. The residential REVON services are designed for personal Internet uses. You may not use the residential REVON services for commercial purposes. You may not run a server in connection with the REVON services nor may you provide network services to others via the REVON services. Examples of prohibited servers and services include but are not limited to mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. Some business services may be exempt from these limitations.

Traffic Management Policies

Cable Bahamas uses traffic management policies to ensure proportional access to its network for all REVON Internet customers. Some P2P applications used for non real-time file sharing can consume a disproportionate amount of upstream bandwidth causing disruption to other customers on Cable Bahamas’ network. Cable Bahamas’ traffic management policies were introduced to quickly address any upstream congestion caused by these P2P applications while standard network expansion activities are undertaken to increase the bandwidth availability for all users.

Cable Bahamas’ traffic management policies come into effect only if upstream network congestion occurs on a network segment. If congestion occurs, the traffic management policies reduce the amount of upstream bandwidth available for P2P applications completing non real-time file transfer activity to 80 kbps per end-user.

Cable Bahamas’ traffic management policies do not affect download speeds and will not affect real-time interactive activities such as online gaming, banking, e-mail or VoIP services. For the majority of Cable Bahamas customers, the Internet experience is unaffected by our traffic management policies and both upstream and downstream bandwidth will be available to ensure the full operation of any application.

The traffic management policies implemented by Cable Bahamas use IP addresses to make real-time traffic management decisions in relation to Cable Bahamas’ network. Since IP addresses have the potential to be linked to an individual’s customer account, IP addresses could be considered personal information. The traffic management policies implemented by Cable Bahamas do not involve capturing, storing or archiving this information in any way.

Violation of this Agreement

Cable Bahamas does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, Cable Bahamas will respond appropriately if it becomes aware of inappropriate use of the Services. Although Cable Bahamas has no obligation to monitor the Services and/or the network, Cable Bahamas reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and REVON Broadband Internet customers. Cable Bahamas prefers to advise customers of inappropriate behaviour and any necessary corrective action. However, if you use the Services in a way that Cable Bahamas, in its sole discretion, believes violates this Agreement, Cable Bahamas may take any responsive actions we deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. Cable Bahamas will not have any liability for any such responsive actions. The above-described actions are not Cable Bahamas exclusive remedies and Cable Bahamas may take any other legal or technical action it deems appropriate. Cable Bahamas reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on Cable Bahamas servers and network. During an investigation, Cable Bahamas may suspend the account or accounts involved and/or remove material, which potentially violates this Agreement. You hereby authorise Cable Bahamas to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include Cable Bahamas providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in Cable Bahamas’ Privacy Policy. Upon termination of your account, Cable Bahamas is authorised to delete any files, programs, data and e-mail messages associated with such account. The failure of Cable Bahamas to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time. You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.

General

  • Customer Computer It is your responsibility to ensure that your computer equipment meets the requirements set out by Cable Bahamas as may be amended from time to time, that are necessary to use the Services.
  • Relocating Cable Modem You agree not to relocate Cable Bahamas’ cable modem within your premises without notifying Cable Bahamas, so that Cable Bahamas may schedule a mutually agreeable time to undertake such work.
  • Personal Pages You may create personal pages on our World Wide Web Server (the “Site”). On the Site, you can conceive, design, create, maintain, and publish texts, diagrams, illustrations, audio clips and related materials for access by a global audience. You warrant that the content on your Site is suitable for publication, is not libelous or defamatory, does not breach the intellectual property rights (including, without limitation, copyright) of any third party, and complies with all laws, regulations, court orders and other legal requirements. While it is your responsibility to regulate and control all content on the Site, Cable Bahamas may decide to suspend or delete your home page without your consent if you violate this Agreement. In addition, if Cable Bahamas determined that it is appropriate, Cable Bahamas may either. i) issue a warning to you; ii) suspend your access to some or all of the Services; or iii) terminate this Agreement, inclusive of your access and use of the Services.
  • Ownership of Addresses Cable Bahamas owns all addresses provided to you, including but not limited to IP addresses, e-mail addresses and personal Web page addresses. CABLE BAHAMAS MAY MODIFY OR CHANGE SUCH ADDRESSES AT ANY POINT IN TIME AND SHALL IN NO WAY BE REQUIRED TO COMPENSATE YOU FOR SUCH CHANGES.
  • End User Licenses You agree to comply with the applicable terms and conditions of all end user license agreements accompanying any software or plug-ins to such software distributed in connection with the Service. All such end user licenses will terminate upon termination of this Agreement. In the event of an inconsistency between the terms of this Agreement and any such license, the terms of this Agreement shall prevail.
  • Multiple Users You acknowledge that you are executing this Agreement on behalf of all persons who use the Services through your computer. You assume all liability for such use of the Services and are responsible for ensuring that all such other users understand and comply with the terms and conditions of this Agreement.
  • No License; Intellectual Property of Cable Bahamas and Others Nothing within the Services or any additional services offered by Cable Bahamas from time to time or through any Cable Bahamas web site shall be construed as conferring any license of Cable Bahamas’ or any third parties’ intellectual property rights, whether by estoppel, implication, waiver, or otherwise. You acknowledge and agree that Cable Bahamas’ web sites, the Services and/or additional services offered by Cable Bahamas from time to time are protected by copyright, trademark, patent, or other proprietary rights. No portion of the Services or Cable Bahamas’ web sites are affiliated with or endorsed by any third party software. By using said software, you accept all responsibility for obtaining licensing grants and permission to connect to these applications directly from the appropriate third party service provider. You agree not to defame or disparage Cable Bahamas, the trademarks or service marks of Cable Bahamas as shown below or as may be amended from time to time.

Terms & Conditions of Add-on Discounts

  • Customers must be in good standing within the last 30 days at the time of purchase to qualify for the discounted rate on the TV add-on packages.

By using Cable Bahamas’ Internet services, also known as REVON and such services (collectively, the “Services”) provided by Cable Bahamas Ltd., its partners and associates (collectively, “Cable Bahamas”), you agree to the following terms of this Acceptable Use Policy, including the general terms contained below: This Acceptable Use Policy constitutes the agreement between Cable Bahamas (“Cable Bahamas” or “our”) and the customer (“you” or” your”) subscribing to the Services. This Acceptable Use Policy governs your use of the Services and any devices and/or equipment used to support the Services, including without limitation, a cable modem and software used in conjunction with the Services which is sold or loaned to you from Cable Bahamas for your use solely in connection with the Services (collectively, the “Equipment”). By activating or using the Services, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with terms and conditions of Cable Bahamas’ Terms of Services (collectively, the “Agreement”). If you do not wish to be bound by this Agreement or any modifications, which may be made by Cable Bahamas from time to time (as described in the following paragraph), do not activate or use the Services and immediately contact Cable Bahamas. Cable Bahamas may revise this Agreement and provide notice of such material changes to you by sending you an electronic mail message at your REVON e-mail address. Such changes shall be deemed effective upon the electronic communication being retrievable by you.

YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION THAT IS SENT TO YOU OR POSTED ONLINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICES AFTER YOU ARE NOTIFIED OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY SUCH CHANGES.

If you do not agree with any of the amendments to this agreement, you agree to stop using the Services and to provide notice to Cable Bahamas of your termination of this Agreement in accordance with the terms of the Terms of Service. Cable Bahamas customers should consult this document regularly to ensure that their usage conforms to the most recent version. In the event of conflict between any customer agreement and this Agreement, the terms of this Agreement will govern. Please refer to the customer agreement specific to the service that you are using. Cable Bahamas provides a variety of Internet services to residences and businesses: REVON Charge, REVON Boost, REVON Velocity and REVON Extreme. Broadband Internet services allow residential customers to connect to the Cable Bahamas high-speed backbone network, and the Internet. REVON Pro Broadband allows businesses to connect to the Cable Bahamas Broadband backbone network, and the Internet for the purposes of transacting business. The Services use resources that are shared with many customers. Moreover, the Services provide access to the Internet, which is used by millions of others. Each user benefits by being able to share resources and communicate almost effortlessly with other members of the user community. However, as with any community, the benefits and privileges available from the Services, and the Internet in general, must be balanced with duties and responsibilities designed to guarantee uniform access to all customers of the Services. Use of the Services is subject to the following rules and guidelines. You are responsible for ensuring that the use of all Services provided to you complies with this Agreement.

Illegal Activity

Use of the Services for any activity that violates local or international law, order or regulation, is a violation of this Agreement. Prohibited activities include, but are not limited to:

  1. Posting, storing, transmitting or disseminating unlawful material, including without limitation, child or other pornography, any content, data or other material which is libelous, obscene, hateful, unlawful, threatening, reaction or ethnically offensive, defamatory or which in any way constitutes or encourages conduct that would constitute a criminal offense.
  2. Disseminating material which violates copyright or intellectual property rights. The customer assumes all risk regarding whether material is in the public domain;
  3. Pyramid or other illegal soliciting schemes; or
  4. Fraudulent activities; including but not limited to: impersonating any person or entity, or forging anyone’s digital or manual signature.
Security

You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services. The Services may not be used to breach the security of another user, or to attempt access to anyone’s computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools is strictly prohibited. YOU MAY NOT DISRUPT THE SERVICES. The Services also may not be used to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to crash a host. The transmission or dissemination of any information or software that contains a virus or other harmful feature is also strictly prohibited. YOU ARE RESPONSIBLE FOR THE SECURITY OF ANY DEVICE YOU CONNECT TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, DATA STORED ON THAT DEVICE. In particular, Cable Bahamas recommends against enabling file or printer sharing of any kind. Cable Bahamas recommends that any files or services you make available for remote access be password protected.

Inappropriate Content

Cable Bahamas is not responsible for any content you post, store, transmit, disseminate or access through use of the Services. Any content questions or complaints you may have regarding content you access should be addressed to the content provider. 

You are responsible for information published to the Web or other Internet services, through your account. Cable Bahamas reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it, at its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful. 

Cable Bahamas has no obligation to monitor transmissions made on the Services. However, Cable Bahamas has the right to monitor such transmissions and to disclose the same in accordance with Cable Bahamas’ Privacy Policy. By using the Services to publish, transmit or distribute content, a user is warranting that the content complies with this Agreement and licenses and authorizes Cable Bahamas to reproduce, publish, distribute and display such content worldwide.

Electronic Mail

Cable Bahamas limits the number of e-mail messages that you can send through the Services using Cable Bahamas’ e-mail servers in a 24-hour day. Cable Bahamas defines an e-mail message as one message sent to one recipient. For example: a single message addressed to three recipient e-mail addresses would count as three e-mail messages. Cable Bahamas REVON Broadband Internet subscribers are limited to 1000 e-mail messages per 24-hour day and no single e-mail message can be addressed to more than 99 recipient e-mail addresses. Cable Bahamas REVON Pro subscribers are limited to 1000 e-mail messages per 24-hour day and no single e-mail message can be addressed to more than 400 recipient e-mail addresses. The Services may not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages may be sent only to those who have explicitly requested them. 

The Services may not be used to collect responses from unsolicited e-mail sent from accounts on other Internet hosts or e-mail services which violates this Agreement or the acceptable use policy of any other Internet service provider. Moreover, unsolicited e-mail may not direct the recipient to any Web site or other resource, which uses the Services. Forging, altering or removing electronic mail headers is prohibited. However, you may insert additional characters into your from: and reply-to: addresses in order to prevent your true address from being automatically added to the mailing lists used by bulk e-mailers. In this case, your true address must remain obvious to any human viewer. For example, you may substitute nospam.mark.smith for mark.smith.
You may not reference REVON, REVON Broadband or REVON Pro (e.g. including Organization: REVON High-Speed Internet in the header, or by listing an IP address that belongs to Cable Bahamas ) in any unsolicited e-mail, even if that e-mail is not sent through Cable Bahamas. Cable Bahamas owns all IP addresses and e-mail usernames for all Services. Mail Bombing is prohibited. You may not send numerous copies of the same or substantially similar messages, nor may you send very large messages or files to a recipient with the intent to disrupt a server or account. The propagation of chain letters is prohibited, whether or not the recipient wishes to receive such mailings. Cable Bahamas is not responsible for the forwarding of e-mails sent to any account that has been suspended or terminated. Such e-mails will be returned to sender, ignored, deleted, or stored temporarily, at Cable Bahamas’ sole discretion.

Bandwidth, Data Storage and Other Limitation

You must comply with the current bandwidth, data storage and other limitations on the Services. You must ensure that your activity while using the Services does not improperly restrict, inhibit or degrade any other customer’s use of the Services, nor represent (in the sole judgment of Cable Bahamas.) an unusually large burden on the network itself, such as, but not limited to, peer-to-peer (P2P) file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. The guidelines for Bandwidth Usage/month for each service package are the following: REVON Charge, 100 gigabytes; REVON Boost, 175 gigabytes; REVON Velocity, 250 gigabytes; REVON Extreme, 300 gigabytes; REVON Pro 10, Unlimited; REVON Pro 14, Unlimited; REVON Pro 18, Unlimited; (all bandwidth is based on combined download and upload). Cable Bahamas reserves the right to set specific limits for Bandwidth Usage and charge for excessive Bandwidth Usage for residential services at any time. In addition, you must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede Cable Bahamas’ ability to deliver the Services and monitor the Services, backbone, network nodes and/or other network services.

UNDER NO CIRCUMSTANCES, WHATSOEVER, ARE YOU PERMITTED TO RESELL, SHARE, OR OTHERWISE DISTRIBUTE THE SERVICES OR ANY PORTION THEREOF TO ANY THIRD PARTY WITHOUT THE WRITTEN CONSENT OF CABLE BAHAMAS AND PAYMENT OF APPLICABLE FEES. For example, you cannot provide Internet access to others through a dialup connection, host shell accounts over the Internet, provide e-mail or news service, or send a news feed unless express permission is granted by the customer agreement. The residential REVON services are designed for personal Internet uses. You may not use the residential REVON services for commercial purposes. You may not run a server in connection with the REVON services nor may you provide network services to others via the REVON services. Examples of prohibited servers and services include but are not limited to mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. Some business services may be exempt from these limitations.

Traffic Management Policies

Cable Bahamas uses traffic management policies to ensure proportional access to its network for all REVON Internet customers. Some P2P applications used for non real-time file sharing can consume a disproportionate amount of upstream bandwidth causing disruption to other customers on Cable Bahamas’ network. Cable Bahamas’ traffic management policies were introduced to quickly address any upstream congestion caused by these P2P applications while standard network expansion activities are undertaken to increase the bandwidth availability for all users.

Cable Bahamas’ traffic management policies come into effect only if upstream network congestion occurs on a network segment. If congestion occurs, the traffic management policies reduce the amount of upstream bandwidth available for P2P applications completing non real-time file transfer activity to 80 kbps per end-user.

Cable Bahamas’ traffic management policies do not affect download speeds and will not affect real-time interactive activities such as online gaming, banking, e-mail or VoIP services. For the majority of Cable Bahamas customers, the Internet experience is unaffected by our traffic management policies and both upstream and downstream bandwidth will be available to ensure the full operation of any application.

The traffic management policies implemented by Cable Bahamas use IP addresses to make real-time traffic management decisions in relation to Cable Bahamas’ network. Since IP addresses have the potential to be linked to an individual’s customer account, IP addresses could be considered personal information. The traffic management policies implemented by Cable Bahamas do not involve capturing, storing or archiving this information in any way.

Violation of this Agreement

Cable Bahamas does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, Cable Bahamas will respond appropriately if it becomes aware of inappropriate use of the Services. Although Cable Bahamas has no obligation to monitor the Services and/or the network, Cable Bahamas reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and REVON Broadband Internet customers. Cable Bahamas prefers to advise customers of inappropriate behaviour and any necessary corrective action. However, if you use the Services in a way that Cable Bahamas, in its sole discretion, believes violates this Agreement, Cable Bahamas may take any responsive actions we deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. Cable Bahamas will not have any liability for any such responsive actions. The above-described actions are not Cable Bahamas exclusive remedies and Cable Bahamas may take any other legal or technical action it deems appropriate. Cable Bahamas reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on Cable Bahamas servers and network. During an investigation, Cable Bahamas may suspend the account or accounts involved and/or remove material, which potentially violates this Agreement. You hereby authorise Cable Bahamas to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include Cable Bahamas providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in Cable Bahamas’ Privacy Policy. Upon termination of your account, Cable Bahamas is authorised to delete any files, programs, data and e-mail messages associated with such account. The failure of Cable Bahamas to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time. You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.

General

  • Customer Computer It is your responsibility to ensure that your computer equipment meets the requirements set out by Cable Bahamas as may be amended from time to time, that are necessary to use the Services.
  • Relocating Cable Modem You agree not to relocate Cable Bahamas’ cable modem within your premises without notifying Cable Bahamas, so that Cable Bahamas may schedule a mutually agreeable time to undertake such work.
  • Personal Pages You may create personal pages on our World Wide Web Server (the “Site”). On the Site, you can conceive, design, create, maintain, and publish texts, diagrams, illustrations, audio clips and related materials for access by a global audience. You warrant that the content on your Site is suitable for publication, is not libelous or defamatory, does not breach the intellectual property rights (including, without limitation, copyright) of any third party, and complies with all laws, regulations, court orders and other legal requirements. While it is your responsibility to regulate and control all content on the Site, Cable Bahamas may decide to suspend or delete your home page without your consent if you violate this Agreement. In addition, if Cable Bahamas determined that it is appropriate, Cable Bahamas may either. i) issue a warning to you; ii) suspend your access to some or all of the Services; or iii) terminate this Agreement, inclusive of your access and use of the Services.
  • Ownership of Addresses Cable Bahamas owns all addresses provided to you, including but not limited to IP addresses, e-mail addresses and personal Web page addresses. CABLE BAHAMAS MAY MODIFY OR CHANGE SUCH ADDRESSES AT ANY POINT IN TIME AND SHALL IN NO WAY BE REQUIRED TO COMPENSATE YOU FOR SUCH CHANGES.
  • End User Licenses You agree to comply with the applicable terms and conditions of all end user license agreements accompanying any software or plug-ins to such software distributed in connection with the Service. All such end user licenses will terminate upon termination of this Agreement. In the event of an inconsistency between the terms of this Agreement and any such license, the terms of this Agreement shall prevail.
  • Multiple Users You acknowledge that you are executing this Agreement on behalf of all persons who use the Services through your computer. You assume all liability for such use of the Services and are responsible for ensuring that all such other users understand and comply with the terms and conditions of this Agreement.
  • No License; Intellectual Property of Cable Bahamas and Others Nothing within the Services or any additional services offered by Cable Bahamas from time to time or through any Cable Bahamas web site shall be construed as conferring any license of Cable Bahamas’ or any third parties’ intellectual property rights, whether by estoppel, implication, waiver, or otherwise. You acknowledge and agree that Cable Bahamas’ web sites, the Services and/or additional services offered by Cable Bahamas from time to time are protected by copyright, trademark, patent, or other proprietary rights. No portion of the Services or Cable Bahamas’ web sites are affiliated with or endorsed by any third party software. By using said software, you accept all responsibility for obtaining licensing grants and permission to connect to these applications directly from the appropriate third party service provider. You agree not to defame or disparage Cable Bahamas, the trademarks or service marks of Cable Bahamas as shown below or as may be amended from time to time.

1. We think that CBL’s BUSINESS LANDLINE service provides your business with a great deal, and we want you and other phone users to enjoy it properly. We can offer your business great prices and high quality calls because we have targeted our BUSINESS LANDLINE service at commercial and not-for-profit customers. We want to make sure that our customers use the most appropriate package for their pattern of usage and that their use of the phone remains legal, so we set out some simple rules for your business to follow. We also explain what we may do if you don’t follow them.

2. By using our services, you agree to follow these rules. We may update them from time to time, and we’ll give you one month’s notice of any changes. If you don’t agree to this policy or the changes, you must let us know and stop using our services.

3. You are responsible for ensuring that your business’s employees and anyone else using your BUSINESS LANDLINE service also follow these rules.

 

Who can use your BUSINESS LANDLINE service

4. The BUSINESS LANDLINE service is for you and for your business’s employees. If you have multiple lines, have registered any extensions with us, or if your plan allows you to extend your service to another business or mobile number, they can also be used for the BUSINESS LANDLINE service, and calls from them will be included in any limits in your phone package.

 

What you can use your BUSINESS LANDLINE service for

5. The BUSINESS LANDLINE service is designed for normal business use, and we offer different plans suited to different patterns of use. So your BUSINESS LANDLINE service should not be used:

• By people who are not employed by your business

• For resale to others

• In any way that damages other customers’ ability to use the phone service or harms our operations.

 

How much you can use your phone

6. Our packages offer you different levels of use at different prices, including our packages with unlimited local calling and long distance calling. To avoid congestion on our network and to ensure that your business is on the most appropriate package for your usage:

• Unlimited calling means there are no limits on the volumes of calls. However your usage should not be abnormal or try to get around the limitations in this Acceptable Use Policy. We define abnormal usage as above the level of 95% of our business customers on the same package

• If you’re on a package with a fixed number of long distance minutes and you exceed this limit, any calls over the limit will be charged at our out of plan rates.

 

Keeping it legal

7. Our phone service is a great way of keeping in touch with your customers, suppliers and colleagues. However you must comply with the laws of The Bahamas. For example, you (or any equipment that you use with your phone service) must not:

• carry out, promote or assist illegal activities, such as terrorism, fraud, pyramid schemes, human trafficking or child pornography

• promote or threaten violence towards anyone

• abuse or harass anyone, for example by making offensive, libellous, obscene, misleading or menacing comments

• encourage hatred, for example by making racist, sexist, discriminatory or ethnically offensive comments

• make hoax or nuisance calls

• violate anyone’s intellectual property or personal rights.

 

Making this policy work

8. If we think you’ve breached this policy, we may:

• look into the breach

• monitor your usage, for example by comparing your usage to other business’s usage on the same package

• contact you to discuss the apparent breach (using your personal details to make contact with you)

• transfer you to a more appropriate package, charge you for abnormal use or place restrictions on your usage

• suspend or terminate your BUSINESS LANDLINE service and other services you take from us

• issue you with a formal warning

• recover from you the costs that we have reasonably incurred as a result of the violation

• take any other legal or technical action that we deem appropriate.

 

If you agree in writing to stop committing the breach, we may lift the restrictions or restore your service.

 

9. In serious cases, we may report you to the police or another law enforcement agency, and give them your personal information. Sometimes, we might be asked by public bodies such as law enforcement agencies to give information about you and your business. If those requests are lawful, we obey them. We may also cooperate with other communications providers to enforce this policy and their policies.

1. We want to provide you with a great television experience at competitive prices. We’ve designed our BUSINESS TELEVISION service specifically for our business customers, and we ask you to keep to some simple rules which we set out here. We also describe what we will do if you are unable to do this.

2. By using our services, you agree to follow these rules. We may update them from time to time, and we’ll give you one month’s notice of any changes. If you don’t agree to this policy or the changes, you must let us know and stop using our equipment and services.

3. You are responsible for ensuring that your business’s employees and anyone else using your BUSINESS TELEVISION service also follow these rules.

 

Where you can enjoy the BUSINESS TELEVISION service

4. Our BUSINESS TELEVISION service is for you and for your business’s employees whilst they are on the business’s premises that have been specified in the BUSINESS TELEVISION agreement with CBL. Unless otherwise agreed with CBL, you should have a separate account for any other premises occupied by your business.

5. Your customers are welcome to use our BUSINESS TELEVISION service only if this is permitted in your agreement with CBL.

 

Using our BUSINESS TELEVISION equipment

6. We provide you with set-top boxes and other equipment so that you can enjoy our television service. You must keep our equipment in the premises you’ve specified in your agreement with us, and must not move it to or share it with other businesses or premises.

7. You must not disturb, tamper with, reroute or interfere with any component of our cable system in case this damages the equipment or your television service. You must not connect our equipment to any other equipment or modify our equipment or cable installation.

 

Using our BUSINESS TELEVISION service

8. You must not resell the BUSINESS TELEVISION to other businesses or people.

9. You must not use our television service for purposes that are forbidden by the laws of The Bahamas.

10. You should ensure that minors and vulnerable people do not have access to unsuitable material, using parental controls when appropriate.

 

Making this policy work

11. If we think you’ve breached this policy:

• we will look into the breach and may contact your business to discuss the apparent breach (using your personal details to make contact with you)

• we may issue your business with a warning letter or email

• we may suspend your television service (and perhaps the other services you receive from us)

• if this is the first time your business breached this policy, we will reconnect you once you have sent us a signed acknowledgement of our letter or email

• if you breach this policy for a second time, we may not reconnect you until our audit department visits your business and conducts an investigation. We may charge you for the cost of this audit visit (minimum $100), and may also increase the amount of deposit required from you

• if you breach this policy again, we may terminate our contract with you and remove our equipment, and refuse to provide you with our services again

• we may recover from you the costs that we have reasonably incurred as a result of the violation, including the costs of damage to our equipment or installation and the costs of collecting our equipment

• we may also take any other legal or technical action that we deem appropriate.

• If you agree in writing to stop committing the breach, we may restore your service.

12. In serious cases, we may report your business to the police or another law enforcement agency, and give them your personal information. Sometimes, we might be asked by public bodies such as law enforcement agencies to give information about you. If those requests are lawful, we obey them. We may also cooperate with other television providers to enforce this policy and their policies.

  1. We want your business and the other customers of broadband services to enjoy these services to the full. This means that your use of CBL’s REVNET services should respect the rights of others, and here we set out a few rules for your business to follow. We also explain what we may do if you don’t follow them.
  2. By using our services, your business agrees to follow these rules. We may update them from time to time, and we’ll give you one month’s notice of any changes. If you don’t agree to this policy or the changes, you must let us know and stop using our services.
  3. This policy applies to your business’s employees and any other people who use your broadband equipment, services and connections, and your business will be responsible for ensuring that they follow this policy. You are also responsible for all content that your business uses or puts online and for the materials and data on your devices, as well as for your own websites and your pages on other peoples’ websites. We do not take any responsibility for such content.

 

Act legally

  1. While using our services, your business must comply with the laws of The Bahamas. For example, your business must not:

• carry out, promote or assist illegal activities, such as terrorism, fraud, pyramid schemes, human trafficking or child pornography

• promote or threaten violence towards anyone

• host, post, transmit or disseminate any unlawful material or any material considered harmful to minors or vulnerable people

• abuse or harass anyone, for example, by making offensive, libellous, obscene, misleading or menacing comments

• encourage hatred, for example, by making racist, sexist, discriminatory or ethnically offensive comments

• infringe other people’s or organisations’ copyright or intellectual property.

 

Keep secure

  1. You’ll want to keep the equipment which your business uses for our services secure and safe, and you should help other people do the same. So your business must:

• ensure your devices have the right firewall, anti-virus protection and appropriate password protection

• keep your passwords secure, including those used to access our services

• prevent unauthorised access to your equipment or network, or to our services

• not hack, send viruses, spyware, malware or corrupted files to other people’s (including our) devices, servers or networks

• not use or distribute tools that compromise the security of other people’s equipment, systems or networks

• prevent your devices from being used to monitor, overload, interfere with, gain unauthorised access to, or deny service on other people’s accounts, websites, applications, servers or networks

• not impersonate someone else, or misrepresent who you are (like using fake email headers, signatures, sender names or address, or caller identification details)

• not falsify user or transmission information, such as email headers, Internet Protocol addresses, or contact information

• not claim to represent us in communications with others

• comply with the licence conditions applying to any software which comes with our services.

 

Protect other people’s privacy

  1. People don’t like their privacy being invaded. So your business must not:

• send unsolicited communications to people or groups without their agreement (such as spam, mailbombs, chain letters and nuisance calls)

• intentionally distress, offend or worry anyone (through things like hoax calls or upsetting emails)

• use our services contrary to the generally accepted moral standards in The Bahamas

• intercept other people’s data or obtain information from them fraudulently

• behave deliberately in a way that might harm children or other vulnerable people

• interfere with people’s rights to privacy and their legal enjoyment of broadband services.

 

Share our network fairly

  1. CBL’s business packages give you access to world-class broadband services. To help us to provide these services:

• you must not restrict or degrade our ability to deliver or monitor our services

• unless you have our agreement, you must not distribute, resell or provide broadband or network services to other businesses or people.

 

Making this policy work

  1. If we think your business has breached this policy, we may:

• look into the breach

• monitor your business’s bandwidth, usage or content

• contact you to discuss the apparent breach (using your personal details to make contact with you)

• issue your business with a formal warning

• restrict your access to any material or data, including websites and email accounts

• remove any unacceptable content, or suspend or delete your web pages

• block, limit or suspend your access to or consumption of any or all of our services

• terminate your agreement with us and your access to our services (with or without notice)

• recover from your business the costs that we have reasonably incurred as a result of the violation

• take any other legal or technical action that we deem appropriate.

If you agree in writing to stop committing the breach, we may lift the restrictions or restore your service.

]]> These terms and conditions are divided into a general section that applies to every service, and then into service-specific terms and conditions. Please read the GENERAL TERMS AND CONDITIONS and each section that applies to your service because all of the relevant terms will apply to you.

 

You will be held liable for any charges associated with the use of your services by your users. In this section, reference to “you” includes reference to your users.

 

1. Use:

a. This service is only for your use and for your users in terms of their contracts with you.

b. Business Internet has an acceptable use policy which you must comply with when you use the services, and you can find this here.

c. YOU MUST KEEP YOUR PASSWORDS AND OTHER INFORMATION NEEDED TO ACCESS THE SERVICES SAFE AND SECURE AT ALL TIMES.

 

2. Risks of using this service:

a. Any use of the Internet and data services involves risks of hacking or interception by third parties, malware and viruses that may corrupt or interfere with or damage your service, your business services, and/or devices. In making use of the service you acknowledge these risks and accept them and you indemnify and hold us harmless against all and any loss, liability, actions, costs, demands and damages of all and every kind (including direct, indirect, special or consequential damages), arising out of or in connection with an inability to use or access the service, or failure or delay in the performance of the service as a result of hacking or interception or other unauthorised intrusions into or alterations to the service or the device.

b. You must take adequate precautions to protect your and your users’ use of the service and any device provided with it, in order to secure your hardware, software, and information you have created or stored using the service and/or the device.

c. You acknowledge that the Internet is generally accessible and we do not control what is posted to or made available on the internet (content), and we are therefore not liable for any inappropriate or misleading content that you may access whether deliberately or accidentally, or any consequence of your accessing this content.

d. We are not liable to notify you if an address to which you have sent an email or directed any content (a communication) is no longer in use or denies access to your communication.

 

3. Prohibitions that apply to your use of the services:

a. You and your users may not undertake activities such as spamming or hacking or any cyber intrusion or cyber attack of or other unlawful activity in relation to any other person’s device or service, whether provided by us or not, during your use of the service and/or device. “Spamming” includes the use of electronic junk mail or unsolicited mail or contacting third parties without their permission.

b. You may not transmit or distribute and you shall ensure that your users do not transmit or distribute:

i. any unlawful materials including child or other pornography, libellous content, or material which is hateful or threatening or in any way encourages or constitutes conduct that is or could be unlawful, or which may incite violent behaviour or civil unrest;

ii. material that violates any other person’s copyright or intellectual property rights;

iii. information that seeks or encourage membership of a pyramid scheme or otherwise illegally solicits membership; and

iv. material that suggests or represents to any other person that you have an identity that is not your own including using a digital signature that belongs to another person.

c. You may not and you shall ensure that your users do not:

i. use any tools designed to or which could have the effect of compromising the security of other networks or users including password-guessing programmes, cracking tools, packet sniffers or network-probing tool; or

ii. overload your service or our network;

iii. send bulk or unsolicited emails using the service; or

iv. deliberately use software that contains a virus or other harmful software that may be transmitted to third parties using our service.

d. It is forbidden to use the services in any way that may endanger children, or to use the services or allow the services to be used to expose them to disturbing and harmful materials including adult experiences. We recommend that you do not allow children to use internet services unsupervised.

e. In general, your use of the services must accord with the moral standards in The Bahamas that would generally be considered to not run counter to the public interest.

 

4. Monitoring and take down:

a. We have the right to monitor your use of the services to measure your consumption of data and to review the content that you access or make available to third parties and by activating the service, you accept that we may do so, subject to clause 8 of the GENERAL TERMS AND CONDITIONS, except if (b) applies.

b. We may take down or remove any content that you make available using our service if it should be in breach of this contract or any law, or contravene clause 3c, or constitute offensive or otherwise inappropriate content, in our discretion, at any time. If a regulatory authority or the policy or any other government agency with the relevant power (we will refer to them as “law enforcement officers”) requires us to remove content that you or any user has posted using our service because we are caching or hosting that content, we will be required to comply with that order without notice to you.

c. You may refer a matter to us in terms of clause 14 of the GENERAL TERMS AND CONDITIONS if you dispute our right to take down or grant access to your content to law enforcement officers.

d. If we terminate your use of the service under clause 11 of the GENERAL TERMS AND CONDITIONS or otherwise as specified in these SPECIFIC TERMS AND CONDITIONS, we may delete all files, programmes, data and email messages associated with your account.

 

5. Installation of the service and/or a device:

a. In order to install the service and any device, we will need to access your premises and you give us permission to do so at a mutually convenient time.

b. Installation will not guarantee that the service or device will work immediately as you may need to activate the service or device according to our instructions. If you cannot access the service or use the device you should notify us immediately on 601-8910 (New Providence), 602-8810 (Grand Bahama) or toll free at 1-242- 300-2200 or via email at commercialsupport@cablebahamas.com.

c. If you or any user is not using our devices to access the service, then we cannot guarantee when or if you will be able to access or use the service and device.

d. You may not move the device from the premises in which we installed it, without giving us written notice, nor may you connect or network a device to any other device without our permission.

e. After installation you must confirm that your device is in full working order to our installer.

f. In this section, a device may include software that enables you to use the device.

 

6. Charges:

a. You are required to make payment of the installation charge and the first month’s charges in advance, and prior to installation.

b. We will invoice you at the time you place your order with us. Thereafter payment of the monthly charges must be made monthly in advance.

c. All the other provisions of clause 4 of the GENERAL TERMS AND CONDITIONS will apply to charges.

You will be held liable for any charges associated with the use of your services by your users.

 

1. Commercial use:

a. The services sold to you under this contract are for commercial purposes only. By “commercial purposes” we mean services offered in a commercial environment where our customer provides business TV as an amenity to generate their own revenue.

b. This service is only for your use and the use of the people that you authorise to use the service.

 

2. Device ownership and return:

a. In order to provide you with television services, we may make a device available to you for the duration of the contract.

b. This device(s) will remain our property and on termination of this contract for any reason, the device(s) must be returned to us in working condition.

 

3. Terms and conditions of use of the device:

a. All of the terms and conditions set out in clause 3 of the GENERAL TERMS AND CONDITIONS apply to the device referred to in this section.

b. We may require you to pay a security deposit in order to take delivery of the device and prior to installation.

c. The device may only be used to receive the signal distributed to the address indicated by you in your order, which may be an address for a commercial business unless otherwise noted.

 

4. Terms and conditions of use of the services:

a. It is forbidden to use the services in any way that may endanger children, or to use the services or allow the services to be used to expose them to disturbing and harmful materials including adult experiences. We recommend that you advise your users that they should not allow children to use cable tv services unsupervised.

b. We may apply additional terms to packages that you choose from time to time, which terms may result in a change from the programmes or channels included in a package, or the prices for additional programmes or channels that may be added to the package from time to time.

c. Business TV has an acceptable use policy which you must comply with when you use the services, and you can find this here.

d. In general, your use of the services must accord with the moral standards in The Bahamas that would generally be considered to not run counter to the public interest.

 

5. Cable installation requirements:

a. In order to install the cable connection to connect the device to the service at your premises, we will need:

i. to connect one or more cables to a ground reference, which may be integrated into your electrical supply point; and

ii. if we cannot identify a suitable location within your electrical supply point we will need to install a separate ground electrode on your premises.

b. In all cases the installation of the cable and connection point must not be disconnected or damaged by you.

c. In addition, we are not liable for damage caused to the cable or the electrical supply point to which it is connected as a result of power surges, outages, storms or work carried out on your electrical supply by third parties.

 

6. Blackouts

a. We provide various channels to you over this service. The channels we provide to you may depend on the package you have selected and the price you are willing to pay.

b. However, not all content on a channel is guaranteed. Blackouts are controlled by various leagues, associations, and networks that maintain the rights to broadcast certain content (“Vendors”) and we must adhere to these restrictions to protect the agreements that enable us to deliver our existing channel line-up.

c. We will be required by Vendors to blackout certain events – in other words we may not be authorised to broadcast these events.

d. We are not responsible for any refunds due as a result of a blackout. We may attempt to insert programming however, this may not always be possible.

 

7. Charges:

a. You are required to make payment of the security deposit and any charges associated with the installation and the first month’s charges in advance, and prior to installation.

b. We will invoice you at the time you place your order with us. Thereafter you will be responsible for payment of the monthly charges.

c. We offer what we call “premium” services which are services that attract a higher charge. We will charge you for the use of premium services for the specific time period that you or your users use the premium services.

]]> THIS VERSION OF OUR CONTRACT IS SPECIFIC TO BUSINESS CUSTOMERS.

These terms and conditions are divided into a general section that applies to every service (GENERAL TERMS AND CONDITIONS), and then into service-specific terms and conditions (SPECIFIC TERMS AND CONDITIONS). The services that we provide are voice telephony, television, and Internet services. Please read the general section and each section that applies to your service because the GENERAL TERMS AND CONDITIONS and the SPECIFIC TERMS AND CONDITIONS that apply to each service and device(s) that you acquire from us, will apply together. Your order and both of these sets of terms and conditions will constitute our contract. If there is any doubt about which of these provisions applies, the GENERAL TERMS AND CONDITIONS will always take precedence.

 

GENERAL TERMS AND CONDITIONS (BUSINESS)

 

1. The parties to this contract: “CBL” is Cable Bahamas Ltd or “us”, “we” or “our”. CBL trades as “Rev”. Our registered office is located at GT Corporate Services, Sassoon House, Shirley Street and Victoria Avenue in Nassau, The Bahamas.

“You”, “your” or “end user” is the business customer who orders, or pays for, and uses any or all of our television, Internet, or voice telephony services (“the services”) and “you” includes your personnel or anyone who uses the services subscribed for by the business customer (“your users”).

This contract also covers any device that is used in conjunction with the services if that equipment is obtained from us (“device(s)”).

 

2. Requirements to conclude a contract as a business customer:

If you wish to obtain services as a business (an incorporated body or any form of company, partnership or other business entity), we will require the following from you before we can activate the services:

a. a security deposit – this may include a separate deposit for any devices that are made available to you, and we may require you to top up the deposit from time to time if the usage of our services by the business and your users increases materially;

b. identification for the individual who is applying for the contract on behalf of the business, who may be an officer of the company, or any other person who is specifically authorised to act on behalf of the business and a personal guarantee of payment from an officer of the company;

c. Copies of Certificate of Incorporation and Good Standing, business licence, VAT registration certificate, and other relevant documents that we may require, such as if the business has a change of name, we will require a change of name certificate;

d. if the business will require devices to be installed in their premises, we will also require consent in writing from the landlord to install the devices;

e. a copy of the business’s value added tax compliance documents; and

f. depending on the number of your users to be connected through the business account, we may also require a resolution from the owners or directors or management of the business authorising the person referred to in (ii).

 

3. This contract applies to your use of the services:

a. This contract comes into effect when you place the order, or when anyone in the business activates any of the services or we activate any of them on your behalf. When this    contract comes into effect it will be binding on the business, your users, and everyone using services in the name of the business.

b. In entering into this contract, the business will be representing to us that it is authorised to trade under the law of the Commonwealth of The Bahamas and to enter into this contract with us, and that it is able to make payment of its accounts as they are presented.

c. Each of your users will be representing to CBL that he or she is at least 18 years of age. If you allow persons who are under the age of 18 to use our services or our devices, you will be liable for all charges that they may incur.

d. You may not resell any service to any person.

e. The services must only be used for lawful purposes, and the transmission of any material or information arising from your use of the services (which includes your users use of the services) must not violate any applicable law or regulation of The Commonwealth of The Bahamas or any other jurisdiction that you are transmitting the material or information to.

f. If you do not pay for the services we may disconnect you or any of your users or suspend your and/or their ability to use the services.

g. If you or your users use our website at www.rev.bs or any related websites that we operate that may be linked to this website in order to view or order services or devices, or to access any policies or other terms and conditions (including these GENERAL TERMS AND CONDITIONS and any SPECIFIC TERMS AND CONDITIONS), please ensure you and your users are familiar with our Acceptable Use Policy which is on our website.

 

4. This contract applies to your and your users’ use of devices:

a. No one may sell or transfer any device that you or your users acquire from us unless you are entitled to take ownership of the device and you have paid for the device in full. A device may include a set top box, telephone, or anything used to provide television, data or telephony services.

b. Once we have installed the device, you may not move it without our permission unless it is moved within the same set of premises. If it is lost, damaged or stolen you must tell us immediately by contacting 601-2200 (New Providence), 602-8800 (Grand Bahama), 1-242-300-2200 (toll free) or via email at commercialsupport@cablebahamas.com.

c. No one may tamper with a device in any way, including changing or removing a device’s serial number, or the equipment identifier of a device, or performing a factory reset, or adjusting any component of a device in any way. If a device is not working, please contact 601-8910 (New Providence), 602-8810 (Grand Bahama), 1-242-300-2200 (toll free), WhatsApp 738-9060 or email at commercialsupport@cablebahamas.com.

d. No one will own a device, however you will be liable for the safety of the device once it has been delivered to you or any of your users. You will bear all the risk of loss due to theft or damage to every device from this date even if it is not paid for in full.

e. You understand that the device rental charge shall continue in full force until the device is returned to us. If your device is not returned to us after your services are disconnected, you will be charged the full price of the device(s).

f. All repairs and modifications of the system shall be made by us or our authorised agents.

g. If a device has become obsolete because new technology has required that you should use a new device to fully benefit from the services, we may require you to return your existing device(s) and obtain a new one. There may fees associated with the upgrade.

 

5. Charges:

a. It is important to remember that whether or not an individual is expressly authorised by the business to receive services and/or devices from us, if they represent to us that they are entitled to receive services and/or devices as your user, and have the relevant business information, we will hold the business liable for all charges incurred by them.

b. Each service will have its own price and the charges must be paid according to the terms and conditions for that service. When you order a service and if we agree to provide it, we will create an account for you in your name, and you will be responsible to pay all the charges on that account for all use of your service, even if you have not used the service yourself.

c. Charges may include the price for a device or a use fee, installation charges, call charges, monthly service charges, or charges per megabyte of usage, as the case may be. We will notify you if there are any additional or other charges and if you have to pay an additional security deposit against any credit risk that we assume in providing a service or a device to you. With effect from 1 July 2018, all charges shall also be subject to the current rate of Value Added Tax (“VAT”) as required by the Government of The Bahamas. This will be reflected on your contract and statements.

d. Statements may be presented to you by email and you agree that an emailed statement will be adequate for delivery to you. If you do not dispute a statement within 1 month under clause 14, the statement will be deemed to be accepted by you.

e. We may offer a refund or other compensation in certain limited cases where we do not meet the quality of service standards, including for example, where we do not reconnect you within 8 hours. Please see clause 7 of the GENERAL TERMS AND CONDITIONS.

f. Charges are payable on the 20th of each month, and some charges may be payable in advance.

g. Statements not paid by the due date shall be subject to a late payment charge on the overdue balance or clause 11 may apply. A returned payment fee shall be charged to your account if your payment is rejected for any reason. We reserve the right to continue provision of the service on a prepaid basis only, or to impose a credit limit on your account with respect to usage charges (billed and unbilled), or to suspend your service until we receive full payment of the outstanding charges.

h. If you are receiving services under a promotion, when that promotion ends, the usual charges for the service will apply.

i. If you are entitled to a discount on any services or if any savings can be made on any service that you are acquiring, we may advise you of this at the time when you acquire the service.

j. Note that the online instant balance shown on your account may differ from the actual balance on your account. This is because we may be updating your account, or you may have incurred additional charges between the time you access your online account and the time you receive your final statement.

6. Changes to the contract or services:

a. Charges and terms and conditions may change. We will provide 1 calendar month’s notice of any changes.

b. You may migrate or upgrade a service on request to us and on payment of the relevant charge which is published on our website at rev.bs.

c. Changes to the terms and conditions will be published on our website along with the effective date when the changes will take effect. Once effective, the changes will be binding on you. You should regularly check the notices that we post to our website so that you are aware of any changes.

d. If you do not want to continue the contract because of any change, you may cancel your services by giving 1 month’s written notice to us by telephone at 601-8910 (New Providence), 602-8810 (Grand Bahama) or toll free at 1-242-300-2200 or via email at commercialsupport@cablebahamas.com.

e. If you continue to use the services, we will assume that you accept the changes and we will continue to charge you at the new price or with the new change in terms and conditions.

7. Quality of service:

a. Our services are provided according to regulated quality of service standards and our Customer Satisfaction Policy. These standards may be reviewed on the website of the Utilities Regulation and Competition Authority (“URCA”) here. Our policy may be viewed here.

b. There may be occasions when the services or any one of them will not be available for example, if we have to perform maintenance or upgrades. We will always try to give you as much notice as reasonably possible beforehand.

c. We cannot warrant that the services will be available 24/7 because force majeure events such as adverse weather conditions, or interruptions in the power supply, civil disturbances, industrial disputes, or a problem with international services that we depend on, or equipment failures may cause interruptions or delays or other difficulties in accessing your services. We are not liable for any failure of the services where it results from force majeure because events of force majeure are not within our reasonable control.

d. We will always try to make the services available as soon as possible.

e. If a service is not available for 3 days or more EXCEPT if (a) or (b) apply, then you may report the problem by emailing commercialsupport@cablebahamas.com or by calling Commercial Support on 242-601-8910 to determine if you are eligible for service credits.

f. If a device is not working, please see clause 4.

 

8. Bundles:

a. If you have ordered a bundle of two or services, please note that the price for each service may be different when it is provided as part of a bundle.

b. If you wish to buy a bundle of services for one or more of your users, you are entitled to ask for the individual charges for each service and we will provide this information to you.

c. We may not be able to provide all of our services as a bundle in a particular geographic area, please check the availability of our services in your area before you place an order.

d. We may require you to take a minimum contract term for a bundle or for one or more services in a bundle. Please ask for more information about this if you wish to purchase a bundle.

e. If one or more services (or users) are terminated or suspended, the standard monthly fee will apply to each remaining service (or user, as the case may be).

 

9. Privacy and data protection:

a. You are allowing your users to make use of services that may require certain information from them to verify that they are who they say they are. Therefore, we will need to obtain certain personal information from your users.

b. We may use this information for purposes of contacting a user to ask you about his or her experience of the services, to notify you or your user about anything that is important in relation to that user’s use of the services, for marketing purposes, to monitor usage, or for quality control. We may need to contact a user by email, SMS or other instant message or by calling that user unless the user asks us not to, in writing, but this will mean you and/or your user may not receive important messages about changes to terms and conditions, prices, and new features.

c. We will keep all information safely stored and will not share this with anyone (unless we are legally required to do so) without your permission. You may always ask us for a copy of all of the information that we have stored for you and your users.

d. We will not store your credit card or bank account information unless you ask us to when you make payment, and you may withdraw your consent to this by notifying us by email to info@cablebahamas.com. For the purposes of efficiency, we may need to store your information outside of The Commonwealth of The Bahamas. If you do not want us to do this, please notify us as soon as possible by email to info@cablebahamas.com.

e. If we are required to disclose your or your users’ information or content that you or your users or any of them have made available using our services, or other activities that you have carried out using any services or devices provided to you by us to law enforcement agencies or on receipt of any warrant or lawful direction, then this clause 9 shall not apply.

f. We will observe the requirements under the Data Protection (Privacy of Information) Act 2003 (See our Privacy Policy).

 

10. Intellectual property rights: You acknowledge that we own the intellectual property rights in and to all of the services or, in the case of devices, we are licensed to provide them to you and the licensor owns all of the intellectual property rights. None of the trademarks and intellectual property of CBL or our device manufacturers may be used by you without our express permission. “Intellectual property” means, for example, ideas, designs, logos, components, formulae, copyright or patents.

 

11. Termination or suspension of services and removal of devices:

a. You may terminate this contract at any time by giving us 1 month’s notice in writing unless noted otherwise.

b. If you do not pay your account on time or within 45 calendar days of the due date, we may suspend. If we intend to suspend the services we will give you 5 business days’ notice but you should take note that charges will still apply while the service is suspended. The notice will set out what you are required to do to avoid suspension. If you fail to pay your account even after the suspension notice has been served on you, we may disconnect you from the services on a further 5 days’ notice. We will then pass your account to a collection agent and legal action may be taken to recover the unpaid debt.

c. If you have not paid on time or at all for a device, or if we suspect or find out that you have tampered with the device in any way, or conducted activity which interferes with or compromises the integrity of our computer network or equipment, or constitutes unauthorised use of equipment, we may suspend services to all or any users, and/or we may wish to remove the devices and you give us permission to enter your premises to do so.

d. If you or any user uses the services or a device or both in breach of this contract or in a manner that is unlawful, or if a user is not at least 18 years old, we will terminate this contract immediately by giving you written notice, and we will terminate your users’ use of the services and remove the device(s).

e. In all cases, you will remain liable for all outstanding charges and late payment fees and we will claim this from you if we take legal action against you, together with any legal fees we incur in doing so.

f. If we reconnect the service or return a devices to you or any user, this will be at our discretion, and you will be required to pay a reconnection fee. We do not waive our right to collect the full balance owed to us by accepting partial payment.

 

12. Warranties:

a. If you received a device(s) from us for use with our services, then we will replace it within a period of 90 days from the date on which we deliver the device(s) to you, if a material defect in the device(s) is discovered but this is the limit of our warranty.

b. This warranty does not apply to any damage caused by you or from ordinary wear and tear.

c. By entering into this contract you acknowledge and agree that we are not the manufacturer of any devices and we do not make any representations (whether direct or indirect, express or implied, written or oral) in connection with any device.

d. We will take reasonable precautions in line with general market practise, to protect our services from unauthorised activity. However, we do not warrant that our services or our devices will be incapable of being hacked, tampered with, or that any other interference by third parties will not take place without our knowledge or without our consent. “Hacking” includes the illegal accessing of and/or subsequent manipulation of private information in any form.

e. OTHER THAN THE LIMITED WARRANTY IN (a) ABOVE, WE DO NOT OFFER ANY OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED, AND WE SPECIFICALLY DISCLAIM ANY WARRANTY OF MERCHANTABILITY, FITNESS OF THE DEVICE OR SERVICE FOR A SPECIFIC PURPOSE, OR INFRINGEMENT OF PATENTS OR COPYRIGHT, OR THAT THE DEVICE OR SERVICE IS ERROR-FREE OR WILL MEET YOUR REQUIREMENTS.

 

13. Your and our liability:

a. WE ARE NOT LIABLE FOR AND YOU AGREE TO DEFEND, INDEMNIFY AND HOLD CBL, ITS DIRECTORS, ITS OFFICERS, AND ITS EMPLOYEES AGAINST ANY CLAIMS, LOSSES, DAMAGES, INJURY, FINES, PENALTIES, COSTS AND EXPENSES INCLUDING LEGAL FEES, THAT MAY ARISE AS A RESULT (WHETHER DIRECTLY OR INDIRECTLY) OF:

i. YOUR (OR YOUR USERS OR ANY OF THEM) USE OR MISUSE OF THE SERVICES OR THE DEVICE;

ii. YOUR BREACH OF THIS CONTRACT OR ANY LAW; AND

iii. ANY COMPROMISE OF YOUR SERVICE OR PERSONAL DATA OR PRIVACY,

b. HACKING OR SPAMMING THAT YOU MAY SUFFER.

BY ENTERING INTO THIS CONTRACT, YOU ACKNOWLEDGE AND AGREE THAT

YOUR SOLE REMEDY IN RELATION TO ANY DEFECT IN THE DEVICE OR SOFTWARE INCLUDING MANUFACTURE OR DESIGN SHALL BE AGAINST THE MANUFACTURER OF THE DEVICE OR SOFTWARE AND CBL, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVANTS, SUBSIDIARIES AND AFFILIATES SHALL HAVE NO LIABILITY OR OBLIGATION TO YOU OF ANY KIND WHETHER IN CONTRACT OR FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCURRED BY YOU OR ANYONE USING THE DEVICE OR SOFTWARE AND WHETHER OR NOT CAUSED BY OUR NEGLIGENCE, TO THE EXTENT THAT THIS IS ALLOWED BY LAW.

c. This clause will apply even after the contract has ended for any reason.

d. You will not be liable for any claims, losses, damages, fines, penalties, costs and expenses (prejudice) under (a) or (b) to the extent that we are proven to have contributed directly and substantially to the prejudice because we intentionally committed a wrongful act. In this case, our liability will be limited to 20% of the total charges incurred by you in the preceding 12-month period or the proportionate amount, as the case may be.

 

14. Dispute resolution and complaint handling:

a. You have the right to complain to us if you are not satisfied with the services you receive from us, or if you dispute the charges for those services.

b. If you wish to dispute any amount that is included in your statement, or any other matter under this contract, you can send a written notice to complaints@cablebahamas.com, or to Cable Bahamas Ltd addressed to the Manager, Complaints Handling and Customer Experience, Robinson Road, P.O. Box CB-13050, Nassau, The Bahamas with your account number, within 10 days of the date of the statement if the matter relates to a statement, or within 30 days for any other matter. You may also submit a complaint by telephone or by going to any of our customer service centres in New Providence, Grand Bahama, Abaco, or Eleuthera.

c. You will need to provide as much information as possible to support a complaint by the business or by your user including (whichever is relevant) the dates on which an event took place, the precise invoice or charges in dispute, and records of any calls or correspondence pertaining to the user in respect of which the complaint is made.

d. Once a complaint is received by us, we will issue the complaint a unique identifier code so that you can track your complaint up to its resolution.

e. A complaint will be acknowledged within 5 business days of receipt by us, at which time we will advise when you can expect to receive a response to your complaint. We will address our response to the business and not to the particular user.

f. In all cases, we will investigate the dispute and notify you of our findings within 30 business days.

g. If our Customer Experience Agents cannot resolve your complaint within an acceptable time it will be escalated. our Manager of Customer Experience will then work with you to try and resolve your complaint. If that does not work, we will then escalate your complaint to the Director of Customer Experience or the Vice-President of Customer Experience. We settle most outstanding complaints at this stage, but if we are unable to resolve your complaint, we will explain our final position.

h. If you are not satisfied with the way we have addressed your complaint, you may escalate the matter and these steps will apply:

i. Indicate that you are not satisfied within 10 days of the date in (f) by sending us a written notice addressed to the Manager, Customer Experience, Cable Bahamas Ltd. P.O. Box CB-13050, Nassau, The Bahamas setting out exactly what the dispute was about and why you are not satisfied with the way we resolved it;

ii. We will arrange a meeting with 2 senior managers to hear and decide on your dispute provided they have enough information at their disposal;

iii. If they need more information they will ask you for it if it is your information, or they will obtain it from the business if it is our information, within 2 business days; and

iv. They will then decide the matter finally within a further 5 business days.

i. In the case where we find that your statement was incorrect, we will correct it and (i) if we overcharged you, we will refund you within 7 days, and (ii) if you were under-charged, the additional amount due will be added to the next month’s statement.

j. These provisions apply to any dispute between your user and us, and we will deal only with you and not each individual user.

 

15. General legal provisions:

a. These general terms and conditions and the terms and conditions of each service constitute the contract between us, which will be governed by the laws of The Commonwealth of The Bahamas, and we and you submit to its jurisdiction.

b. If any term or condition set out here has to be deleted because it no longer applies, that will not affect the rest of these terms and conditions.

c. Our failure to exercise any particular rights or provision of these terms and conditions shall not constitute a waiver of that right or provision, unless acknowledged and agreed to by us in writing.

d. You agree that service of any notice referred to in or required by this contract will be effective if sent to the email address you provide to us. If you wish to give notice to us (other than as already set out in these terms and conditions), then you may do so by delivering a written notice to us at Cable Bahamas Ltd, Robinson Road at Marathon, P.O.
